Acceptance of Terms

By accessing or using the GovExpress platform at govexpress.ai (the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are using the Platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, you may not access or use the Platform.

Description of Services

GovExpress provides federal market intelligence and readiness analysis services for technology companies evaluating or pursuing U.S. federal government contracts. Our services include:

• Federal Readiness Reports — company-specific analyses generated from public federal databases
• Federal market opportunity sizing and agency targeting
• Compliance roadmap and contract vehicle recommendations
• Daily intelligence briefings and agentic monitoring services

GovExpress draws from publicly available federal data sources including SAM.gov, FPDS, USASpending.gov, and FedRAMP. Reports reflect data available at the time of generation and do not constitute legal, financial, or compliance advice.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice.

Accounts & Registration

You may need to create an account to access certain features of the Platform. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security and confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us promptly of any unauthorized access to your account

You may not share your account credentials with third parties, create multiple accounts to circumvent usage limits, or use another user's account without permission.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

Payment & Billing

Certain Platform features require payment. By providing payment information, you authorize us to charge the applicable fees.

• Report purchases: One-time fees are charged at the time of order. Reports are delivered within 24 hours of confirmed payment.
• Subscriptions: Recurring subscription fees are billed in advance on a monthly or annual basis, as selected at checkout.
• Price changes: We will notify you at least 30 days before any price changes take effect for existing subscriptions.
• Refunds: Due to the personalized nature of Federal Readiness Reports, refunds are not available once report generation has commenced. If you experience a technical issue preventing delivery, contact us within 48 hours for resolution.
• Taxes: Stated prices exclude applicable taxes. You are responsible for any taxes associated with your purchase.

Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not:

• Use the Platform to violate any applicable law, regulation, or third-party rights
• Reproduce, resell, or commercially distribute Platform outputs without our prior written consent
• Attempt to reverse engineer, decompile, or extract the Platform's underlying algorithms or data models
• Use automated scripts or bots to access the Platform without authorization
• Introduce malicious code, conduct denial-of-service attacks, or attempt to breach Platform security
• Misrepresent your identity or company affiliation in intake questionnaires
• Use the Platform to obtain a competitive advantage for building a competing service

We reserve the right to investigate and take appropriate action against violations, including account suspension and reporting to law enforcement.

Intellectual Property

GovExpress IP: The Platform, including its design, software, algorithms (including the Federal Readiness Score methodology), branding, and all non-public data compilations, are owned by GovExpress, Inc. and protected by applicable intellectual property laws. These Terms do not grant you any rights in GovExpress IP except as expressly stated.

Your reports: Upon full payment, you receive a non-exclusive, non-transferable license to use your Federal Readiness Report for your internal business purposes. You may share your report internally within your organization but may not publish, resell, or sublicense it without written permission.

Feedback: If you provide us with feedback or suggestions, you grant us a perpetual, royalty-free license to use that feedback to improve the Platform.

Public data: Data sourced from public federal databases (SAM.gov, FPDS, etc.) is subject to applicable government data policies. GovExpress makes no proprietary claim to underlying public data.

Your Data

You retain ownership of the company and contact information you submit to the Platform ("Your Data"). By using the Platform, you grant GovExpress a limited license to use Your Data to generate your reports, operate the Platform, and as described in our Privacy Policy.

You represent and warrant that you have the right to submit Your Data to the Platform and that Your Data does not violate any applicable laws or third-party rights.

We take reasonable steps to protect Your Data. See our Privacy Policy for complete information on how we collect, use, and protect your information.

Disclaimers

THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

GovExpress does not warrant that:

• The Platform will be uninterrupted, error-free, or secure
• Results obtained through the Platform will be accurate, complete, or reliable for any specific purpose
• Defects will be corrected

Federal Readiness Reports are analytical tools based on publicly available data. They are not legal advice, compliance certification, or a guarantee of federal contracting success. You should consult qualified legal counsel, compliance specialists, and government contracting advisors before making material business decisions based on report content.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOVEXPRESS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

IN NO EVENT SHALL GOVEXPRESS'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO GOVEXPRESS IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

These limitations apply regardless of the cause of action and whether GovExpress has been advised of the possibility of such damages. Some jurisdictions do not allow limitation of liability for certain damages, so these limitations may not apply to you.

Termination

Either party may terminate your access to the Platform at any time.

You may terminate by canceling your subscription through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period for subscriptions. No refunds are provided for partial billing periods.

We may suspend or terminate your access immediately if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide reasonable notice where possible.

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Before initiating formal dispute resolution, you agree to contact us at [email protected] to attempt good-faith resolution. If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to a jury trial or to participate in a class action.

Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.

These Terms constitute the entire agreement between you and GovExpress regarding the Platform and supersede all prior agreements. If any provision is found unenforceable, the remaining provisions remain in full force.
